You have a diagnosed mental health condition
The condition must be recognized by the DSM-5. This includes anxiety, depression, PTSD, ADHD, bipolar disorder, OCD, autism, and many others.
Your condition substantially limits a major life activity
The Fair Housing Act defines disability as a condition that substantially limits sleeping, concentrating, interacting with others, caring for yourself, or other daily functions.
Your ESA provides therapeutic benefit
A licensed clinician must determine that your emotional support animal directly alleviates symptoms of your condition — not just that you love animals or enjoy their company.
You need a housing accommodation
You must be a tenant or prospective tenant seeking to keep an ESA in housing with a no-pets policy or other pet restrictions.
Conditions That Commonly Qualify
These are the most common DSM-5 diagnoses that qualify under the Fair Housing Act. This list is not exhaustive — other conditions may also qualify if they substantially limit a major life activity.
Generalized Anxiety Disorder (GAD)

Major Depressive Disorder (MDD)
Including persistent depressive disorder (dysthymia).

Eating Disorders
Including anorexia, bulimia, and binge eating disorder.
Insomnia / Sleep Disorders
When linked to a diagnosed mental health condition.
What Does NOT Qualify
Loving animals or wanting a pet
Affection for animals alone is not a clinical need for an ESA.
General stress or a bad week
Situational stress that doesn't rise to a diagnosable condition doesn't qualify.
A desire to avoid pet deposits
Financial motivation to avoid pet fees is not a clinical need.
A pending or unverified self-diagnosis
Only diagnoses established by a licensed professional count.
