California State Compliance Notice

California AB 468 requires a licensed clinician to establish a bona fide therapeutic relationship before issuing an ESA letter. This means two brief telehealth consultations — an initial session, then a follow-up at least 30 days later. The full process takes approximately 30–35 days. Your fee covers both sessions and the issued letter.

ESA Letters in California: What You Need to Know

Getting an ESA letter in California requires working with a licensed mental health professional who has established a bona fide client relationship with you. As of January 1, 2022, California Assembly Bill 468 (AB 468) significantly tightened the rules around ESA letters — making it illegal for providers to issue letters without completing a proper clinical evaluation.

Under AB 468, a California-licensed mental health professional must: (1) conduct an in-person or telehealth consultation, (2) determine that the individual has a diagnosed mental health condition as defined by the DSM-5, and (3) establish that an emotional support animal is clinically necessary as part of the individual's treatment. Fraudulent or form-letter ESA certifications are now a misdemeanor in California.

ESA Letter Online was built to meet exactly this standard. Every evaluation includes a live telehealth consultation with a licensed California clinician, documented DSM-5 clinical reasoning, and a letter that is designed to withstand landlord scrutiny under both federal FHA requirements and California's state-level FEHA protections.

We serve clients throughout California including Los Angeles, San Francisco, San Diego, Sacramento, San Jose, Oakland, Fresno, and all other cities and counties.

California ESA Laws & Tenant Rights

California Assembly Bill 468 (AB 468)

Effective January 1, 2022, AB 468 prohibits mental health professionals from issuing ESA letters without first conducting a proper clinical evaluation, establishing a therapeutic relationship, and determining that an ESA is clinically appropriate. Violations are a misdemeanor. This law targets the online 'ESA mills' that issued letters without any real evaluation.

California Fair Employment and Housing Act (FEHA)

California's FEHA provides broader housing protections than the federal Fair Housing Act. It applies to more housing types, includes disability protections for a wider range of conditions, and requires landlords to engage in a good-faith 'interactive process' when a tenant requests an ESA accommodation. Landlords cannot charge extra fees or deposits for ESAs under FEHA.

Federal Fair Housing Act (FHA)

The FHA prohibits housing discrimination based on disability. For ESAs, this means landlords must provide reasonable accommodations for tenants with legitimate ESA documentation — including waiving 'no pets' policies and breed or weight restrictions. California enforces FHA protections alongside FEHA, giving California tenants two layers of legal protection.

What California Landlords Can and Cannot Do

Under California law, landlords cannot deny housing due to your ESA, charge pet rent, pet deposits, or fees for ESAs, or apply breed/weight restrictions to ESAs. They may request documentation confirming your disability-related need, but cannot ask for your diagnosis or medical records. They can deny an ESA only if it poses a direct threat to others or would cause undue hardship.

Avoid Fake ESA Letters in California

Dozens of websites sell "instant" or "same-day" ESA letters without any real clinical evaluation. These letters do not satisfy HUD's guidelines or the requirements of a valid accommodation request — and California landlords are increasingly aware of the difference.

  • A legitimate ESA letter requires a real telehealth or in-person consultation with a licensed mental health professional
  • There is no official ESA registry in the United States — any site charging for "registration" is a scam
  • A valid letter must include the clinician's full name, license number, license type, and state of licensure
  • California landlords can verify your clinician's license through the California state licensing board
  • HUD guidance specifically states that letters from unknown internet providers raise reliability concerns
