California Assembly Bill 468 (AB 468)
Effective January 1, 2022, AB 468 prohibits mental health professionals from issuing ESA letters without first conducting a proper clinical evaluation, establishing a therapeutic relationship, and determining that an ESA is clinically appropriate. California Fair Employment and Housing Act (FEHA)
California's FEHA provides broader housing protections than the federal Fair Housing Act. Landlords cannot charge extra fees or deposits for ESAs under FEHA.
Federal Fair Housing Act (FHA)
The FHA prohibits housing discrimination based on disability. For ESAs, this means landlords must provide reasonable accommodations for tenants with legitimate ESA documentation — including waiving 'no pets' policies and breed or weight restrictions.
